THE “ATARI’S GHOSTBUSTERS PSP VIDEO GAME GIVEAWAY” (“SWEEPSTAKES”) CONSISTS OF THIRTY (30) RANDOM DAILY DRAWINGS (EACH A “DAILY DRAWING” AND COLLECTIVELY “DAILY DRAWINGS”) AS DETAILED BELOW.

The Sweepstakes starts at 12:00:01 a.m. Eastern Time (“ET”) on 11/1/09 and ends at 12:00:00 midnight (ET) on 11/30/09 (the “Sweepstakes Period”). See the schedule detailed below for specific entry periods for each Daily Drawing.

The sponsor of this Sweepstakes is Atari, Inc., 417 5th Avenue, New York, NY 10016 (the “Sponsor”). The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein.

ELIGIBILITY: SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF THE DATE OF THEIR ENTRY AND CURRENTLY LIVING IN THE UNITED STATES. Employees of Atari, Inc. (“Sponsor”), the production and distribution company of the film “Ghostbusters,” West Coast Marketing, a division of the Susquehanna Hat Company (“West Coast Marketing”), and each of their respective affiliates, subsidiaries, parents, divisions, advertising/promotion agencies, agents and contractors (collectively “Promotion Parties”), and members of the immediate families (defined as parents, spouses, children and their spouses, and siblings and their spouses) of each and those living in the same household are not eligible to enter or win. Sweepstakes is subject to all local, state and federal laws and regulations. By entering this Sweepstakes, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations. The laws of the State of New York, United States apply to and govern this Sweepstakes and any claims must be raised and resolved in the courts of New York, United States. Void in Puerto Rico, all U.S. territories and possessions and overseas military installations and where prohibited or restricted by law. A prize won by a minor who is at least eighteen (18) years of age but considered a minor in their legal jurisdiction of residency will be awarded in the name of said minor’s parent or legal guardian.

HOW TO ENTER: During the Sweepstakes Period, you may enter via the Internet by following the directions for Sweepstakes entry at www.ghostbustersgame.com/psp (“Entry Web Site”) and providing your first and last name, address, daytime telephone number, date of birth and e-mail address and indicating whether you wish to opt-in to receive the Atari newsletter. Once you have submitted the required information you will be entered into the Sweepstakes (“Entry”). ALL ENTRIES MUST BE RECEIVED ACCORDING TO THE SCHEDULE DETAILED BELOW TO BE ELIGIBLE FOR A SPECIFIC DAILY DRAWING.

ONLY ONE (1) ENTRY PER PERSON OR E-MAIL ADDRESS, REGARDLESS OF WHETHER A PERSON HAS MORE THAN ONE E-MAIL ADDRESS, PER DAY WILL BE ACCEPTED FOR THIS SWEEPSTAKES. ENTRIES WITH DUPLICATE E-MAIL ADDRESSES ARE VOID. THE SPONSOR IS NOT RESPONSIBLE FOR LOST, LATE, DAMAGED INCOMPLETE OR MISDIRECTED ENTRIES.

ENTRIES THAT ARE NOT SELECTED IN A SPECIFIC DAILY DRAWING SHALL NOT REMAIN ELIGIBLE FOR ANY AND ALL SUBSEQUENT DAILY DRAWINGS.

The Entry Web Site's clock will be the official timekeeper for Entries in this Sweepstakes.

The Promotion Parties and their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively the “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; inability to access the Entry Web Site; theft, tampering, destruction, or unauthorized access to, or alteration of entries; data processing that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing or other errors including without limitation, errors in these Official Rules and any marketing material regarding the Sweepstakes; any mail which is late, lost, incomplete, misdirected, stolen, mutilated, illegible, or postage due, or any combination thereof . Proof of entering information at the Entry Web Site is not considered proof of delivery or receipt. Illegible, incomplete, and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be returned or acknowledged. False and/or deceptive entries or acts shall render entrants ineligible. By registering to enter the Sweepstakes, entrant affirms that they have read and accepted these Official Sweepstakes Rules. Any information collected by registering to enter the Sweepstakes shall be used only in a manner consistent with these Official Sweepstakes Rules and with the Sponsor’s Online Privacy Policy, which can be found at the Entry Web Site.

WINNER SELECTION: One (1) winner will be selected in each of the Daily Drawings from among all entries eligible for the specific Daily Drawing. All Daily Drawings will be held on 12/8/09 and be conducted by West Coast Marketing, an independent judging organization. Decisions of West Coast Marketing and Sponsor are and shall be final and binding in all matters relating to this Sweepstakes. Winners will be notified by e-mail and/or telephone within seven (7) days of the drawing date and will be required to respond to such notification within two (2) days. Failure to respond to such notification within this time period, or to comply with any other provision herein, may result in the applicable winner being disqualified and an alternate winner being selected. If a prize notification or prize is returned as undeliverable for any reason, the prize may (at Sponsor’s sole discretion) be awarded to an alternate winner in a subsequent random drawing from among entries eligible for the specific Daily Drawing. Prizes are not transferable, assignable, or redeemable for cash. No substitution for a prize (or parts thereof) by a winner will be allowed. If necessary, due to unavailability of a prize for any reason, a prize of equal or greater value will be awarded at the sole discretion of the Sponsor.

All Federal, state and local tax liabilities, if any, are the responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor and its designee(s) to use the winner’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation.

PRIZES: (Thirty (30) prizes will be awarded): Each Prize consists of one (1) Ghostbusters PSP video game. The approximate retail value of each prize is $29.99. The total approximate retail value of all prizes to be awarded in this Sweepstakes is $899.70. The odds of winning a prize in a specific Daily Drawing are determined by the total number of eligible entries received for the specific Daily Drawing. The Releasees make no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any of the prizes or items received after redemption of the prizes, including, without limitation, their quality, merchantability or fitness for a particular purpose. Any and all warranties for prizes or any portions thereof are contained in the manufacturers' warranties, as relevant.

GENERAL: By entering, entrants acknowledge compliance with the Official Rules, including eligibility requirements and agree to be bound by these Official Rules and the decisions of Sponsor and independent judging organization, if any, which shall be final and binding. By entering this Sweepstakes, entrants agree that Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from the Sweepstakes and the participation or inability to participate in this Sweepstakes, or possession, receipt, acceptance of, damage of, defect in, use, misuse or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winners release the Releasees from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death) and in connection with any lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof). Winners acknowledge that the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to a prize.

Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sweepstakes Entities’ sole control.

If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled before the scheduled conclusion of the Sweepstakes, Sponsor reserves the right to conduct a random drawing to award all remaining prizes from among all eligible, non-suspect entries received for the Sweepstakes prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification or suspension occurs, notification will be posted at the Entry Web Site.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Where a dispute arises about who submitted an Entry, the Entry will be deemed submitted by the authorized account holder of the e-mail account entered. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning Entry and that all eligibility requirements are met.

NOTE: Entry must be made by the entrant, only at the Entry Web Site. Entries made by any other individual or any entity, and/or originating at any other Internet web site or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device, computer program or software to automate the entry process is prohibited.
